Code Section 48–39–10(U), SCDES BCM may issue Emergency General Permits for the reconstruction and repair of previously permitted or grandfathered structures including docks, marinas, non-oceanfront erosion control structures and oceanfront fishing piers. A structure may only be restored to its previously permitted or grandfathered size, configuration, and location. Additionally, the work must comply with all local zoning and building codes and all necessary permits must be obtained from any other local, state, or federal governmental entities that may have jurisdiction over the area. Individual coverage under available Emergency General Permits must be obtained from the Department. 

Applying for an Emergency General Permit

  1. Please visit ePermitting to apply online. An ePermitting account will be necessary to apply. The applicant will need to find an existing site in ePermitting or create a new site for the parcel. If you need assistance, use the BCM Project Manager Finder App to locate the Critical Area Permitting Project Manager for your region.  
  2. There is no administrative fee for an emergency general permit request.
  3. The application will require the following information regarding the project and the property involved:
    1. The names, addresses, telephone numbers, and emails of the landowners and authorized agents
    2. The dimensions, specifications, and purpose of the project
    3. A copy of any permit(s) issued by the Department for non-grandfathered structures will be required
    4. Drawings of the structure are strongly suggested.
